**Terms and Conditions: Hawaii Lifeguard Hui LLC

1. **Scope of Service**:

     a. The Hawaii Lifeguard Hui provides lifeguard services for private events and functions. Our lifeguards are trained and certified, ensuring the safety of all attendees.

     b. Our services do not replace the need for personal responsibility. All attendees should act responsibly and adhere to safety guidelines.

2. **Liability**:

     a. While our lifeguards strive to prevent accidents, The Hawaii Lifeguard Hui cannot guarantee the absolute prevention of incidents.

     b. The Hawaii Lifeguard Hui shall not be held liable for any accidents, injuries, or fatalities that occur during the service period.

3. **Payment and Cancellation**:

     a. Payment must be made in full prior to the event or as otherwise agreed.

     b. Client will pay by check to the “Hawaii Lifeguard Hui” for services as invoiced no later than 10 business days from the start date of the service.

     c. The Client must give the Hawaii Lifeguard Hui a 48 hour notice of cancelation (unless in the case of a medical emergency). Any cancelations done in less than 48 hours will incur a 50% cancelation fee. Any cancelations done in less than 24 hours will incur an 80% cancelation fee. No notice of cancelation will incur a 100% fee.

4. **Client Responsibilities**:

     a. Clients must provide accurate information about the event, including the number of attendees and the nature of the event.

     b. Client must adhere to all safety protocols, rules and regulations provided by the Company, on the day of the service. 

     c. Client must provide their own sun protection, hydration, food and any personal items that the Client may need for the day.

     d. Client must disclose any allergies or pertinent medical history of any members of the Clients party to the Hawaii Lifeguard Hui.

5. **Conduct**:

     a. Our lifeguards have the right to cease services and vacate the premises if they encounter hostile, inappropriate, or dangerous behavior.

     b. Any damages to equipment or harm to our lifeguards due to attendee behavior will be billed to the client.

6. **Force Majeure**:

     a. Neither party will be responsible for failure or delay of performance if caused by an act of nature, war, hostility, or sabotage; electrical, internet, or telecommunication outage; government restrictions; or other event outside the reasonable control of the obligated party.

7. **Termination**:

     a. The Hawaii Lifeguard Hui reserves the right to terminate services if the client breaches any of these terms and conditions.

8. **Governing Law**:

     a. These terms and conditions will be governed by and construed in accordance with the laws of the State of Hawaii, U.S.A.
